An accident caused by a truck’s blown out tire could lead to a lawsuit against the driver and the trucking company.
Trucking company was cited for failing to maintain their tires
A Louisville man who was injured in a
commercial truck accident on Interstate 65 says he plans to file a lawsuit against the truck driver that caused the crash, according to WHAS 11 News. The accident occurred when the truck’s tires blew out and led to a crash that ultimately involved eight vehicles and closed down most of the southbound lanes on I-65 for several hours, according to a WLKY News report at the time. The truck company and its driver are accused of not properly maintaining the vehicle’s tires.
Driving with son
The plaintiff in the lawsuit was driving with his son at the time of the accident. He was slowing down for a construction zone when a commercial truck, whose wheel had blown out, struck his vehicle from behind. The accident ultimately involved a total of eight vehicles. The crash led to multiple injuries, but fortunately no fatalities.
The father says he is planning on suing the driver’s trucking company because it failed to properly maintain the truck, especially the truck’s tires. In the past seven inspections, the Federal Motor Carrier Safety Administration has issued the company with four violations that were related to the condition of their trucks’ tires. Additionally, the truck driver in this accident was already involved in a single-vehicle accident in June that also involved his truck’s tire blowing out.
Driver’s qualifications questioned
Witnesses of the crash claimed the truck driver was driving dangerously in the run up to the crash by running red lights and weaving in and out of traffic. Additionally, police say the driver has a number of health problems, including requiring a power chair for mobility.
Police officers who responded to the crash also say that the truck was not only uninsured, but it also appeared to violate a number of regulations. The father who was struck by the truck says he also plans to sue the trucking company for hiring an unqualified driver.
